1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and Evoastra Ventures (OPC) Private Limited ("Company", "we", "us", "our", "Evoastra") governing your access to and use of our website, platform, internship programs, training services, SaaS tools, and all related digital offerings (collectively, the "Services").

By creating an account, enrolling in a program, making a payment, or otherwise using our Services, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, Refund Policy, and all other policies referenced herein.

2. Eligibility

• You must be at least 16 years of age to use our Services. Users between 16 and 18 years must have parental or guardian consent.
• You must provide accurate, current, and complete information during registration and keep your account details updated.
• You are responsible for all activities conducted through your account and for maintaining the confidentiality of your login credentials.
• Corporate accounts must be registered by authorized representatives of the company.

3. Description of Services

Evoastra operates a multi-faceted digital platform offering:

• Internship & Training Programs: Structured learning programs in Data Science, Data Analytics, AI/ML, and related domains, delivered through online instruction, mentorship, project-based assignments, and assessments.
• SaaS Platform: An enterprise-grade internship management system enabling companies to host, manage, grade, and certify their own interns — including Kanban boards, certificate builders, attendance tracking, grading engines, and communication tools.
• Digital Services: Certificate issuance, recommendation letter generation, portfolio building tools, and career guidance resources.
• Communication Services: Email campaigns, SMS notifications, AI-powered chat assistance, and live support.

4. Internship & Training Program Terms

4.1 Nature of Programs

Evoastra internship and training programs are learning-focused, skill-development programs designed to provide:

• Practical, hands-on experience with industry-relevant tools and technologies.
• Mentorship and guided project work.
• Portfolio development and career preparation.
• Certification upon successful completion.

4.2 No Guaranteed Stipend or Compensation

4.3 No Guaranteed Employment or PPO

Evoastra does not guarantee any of the following:

• Pre-Placement Offers (PPO)
• Full-time employment after internship completion
• Job placement or hiring by any specific company
• Guaranteed freelance work or project contracts

Exceptional performers may be considered for future opportunities, referrals, or full-time roles based on company requirements and individual performance, but such outcomes are not contractually guaranteed.

4.4 Project Work

Interns may work on guided projects, simulated industry use cases, portfolio assignments, research tasks, or selected real-world workflows intended for learning and skill development. Unless specifically stated, project work should be treated as educational exercises and not as professional deliverables for live clients.

4.5 Certificates & Recommendation Letters

• Certificates are issued to eligible interns upon successful completion of program requirements, including participation, attendance, and assessment criteria.
• Recommendation letters are issued at the sole discretion of the Company based on performance, participation, and conduct. They are not guaranteed automatically.
• Certificates are digitally verifiable through our platform and may include QR-code or blockchain-based verification.
• Misrepresentation of certificate details or forging of credentials constitutes a serious violation and will result in certificate revocation and potential legal action.

4.6 Program Fees

Some internship and training programs involve fees. Fee structures vary depending on program duration, mentorship level, certification type, and resources provided. All applicable fees are disclosed at the time of enrollment. Please review our Refund & Cancellation Policy for details on refunds and cancellations.

4.7 User Responsibilities

• You are responsible for providing accurate personal and academic information in your application.
• You must adhere to program schedules, deadlines, and submission requirements.
• Plagiarism, academic dishonesty, or misrepresentation of work will result in immediate termination from the program without refund.
• You agree to maintain professional conduct in all interactions with mentors, peers, and staff.

5. Platform & SaaS Terms

5.1 Account Security

You are solely responsible for maintaining the security of your account credentials. Notify us immediately at support@evoastra.com if you suspect unauthorized access to your account.

5.2 Acceptable Use

You agree not to:

• Use the platform for any unlawful, harmful, or fraudulent purpose.
• Attempt to reverse-engineer, decompile, or access the source code of our platform.
• Upload malicious code, viruses, or scripts designed to disrupt our services.
• Scrape, harvest, or collect data from the platform without authorization.
• Impersonate other users, mentors, or Company representatives.
• Share account credentials or allow unauthorized access to your account.
• Use the platform to send spam, unsolicited messages, or engage in harassment.
• Circumvent security measures, rate limits, or access restrictions.

5.3 Account Suspension & Termination

We reserve the right to suspend or terminate your account, with or without notice, if:

• You violate these Terms or any applicable policies.
• We detect fraudulent, abusive, or suspicious activity.
• You fail to pay applicable fees within the specified timeframe.
• Your conduct negatively impacts other users or the platform's integrity.
• Required by law or regulatory order.

6. Intellectual Property

All content, designs, code, algorithms, trademarks, logos, course materials, assessment frameworks, certificate templates, grading systems, and platform features are the exclusive intellectual property of Evoastra Ventures (OPC) Private Limited or its licensors.

• You may not copy, reproduce, distribute, modify, or create derivative works from our proprietary content without express written consent.
• Course materials and project templates are licensed for personal educational use only and may not be redistributed or sold.
• Projects and assignments you create during the internship remain your intellectual property, though we may use anonymized versions for educational showcasing with your consent.

7. Payments & Billing

• All payments are processed in Indian Rupees (INR) through our authorized payment gateway partners.
• By making a payment, you authorize us to charge the specified amount to your chosen payment method.
• All prices displayed are inclusive of applicable taxes unless stated otherwise.
• We reserve the right to modify pricing for future enrollments. Existing enrollments are not affected by price changes.
• For refund terms, please refer to our Refund & Cancellation Policy.

8. Limitation of Liability

To the maximum extent permitted by applicable Indian law:

• Our Services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied.
• We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services.
• Our total aggregate liability for any claims arising from these Terms shall not exceed the total fees paid by you to us in the 12 months preceding the claim.
• We are not liable for any career outcomes, employment decisions, or business results arising from your participation in our programs.

9. Indemnification

You agree to indemnify, defend, and hold harmless Evoastra Ventures (OPC) Private Limited, its directors, officers, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from:

• Your violation of these Terms.
• Your use or misuse of the Services.
• Your violation of any third-party rights.
• Any content you submit or transmit through the platform.

10. Modifications to Terms & Services

We reserve the right to modify these Terms, platform features, program structures, pricing, and service offerings at any time. Material changes will be communicated through platform notifications or email. Continued use of our Services after such changes constitutes acceptance of the modified Terms.

We may also modify, suspend, or discontinue specific programs or platform features at our discretion, with reasonable notice to affected users where practicable.

11. Dispute Resolution & Governing Law

• These Terms are governed by and construed in accordance with the laws of India, including the Indian Contract Act, 1872; Information Technology Act, 2000; Consumer Protection Act, 2019; and Consumer Protection (E-Commerce) Rules, 2020.
• Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation.
• If negotiation fails, disputes shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, with a sole arbitrator appointed mutually.
• The seat of arbitration and exclusive jurisdiction for any legal proceedings shall be in India.

12. Severability & Waiver

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. Our failure to enforce any provision shall not constitute a waiver of that provision or the right to enforce it later.
